Welcome to Forged Echos LLC. The terms “we,” “us,” and “our” refer to Forged Echos LLC.

Forged Echos LLC operates this website and online store, including all related information, content, features, tools, products, product listings, artist pages, collections, checkout functions, customer support features, and related services offered through the store.

Forged Echos LLC is powered by Shopify, which enables us to provide our online storefront, checkout, and related e-commerce services. Certain products are produced and fulfilled through third-party vendors, including Printful, our print-on-demand fulfillment partner.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access, browse, shop from, or otherwise use our website and services.

By visiting, interacting with, purchasing from, or using our website or services, you agree to be bound by these Terms of Service, our Privacy Policy, our Refund Policy, our Shipping Policy, and any other policies posted on our website. If you do not agree to these Terms or our posted policies, you should not use our website or services.

Section 1: Access and Account

By using our website or services, you represent that you are at least the age of majority in your state, province, or place of residence. If you allow a minor dependent to access or use our website through your device, account, payment method, or supervision, you are responsible for that use.

To browse, purchase, contact us, submit a form, or use certain features of our website, you may be asked to provide information such as your name, email address, billing address, shipping address, payment information, order information, or other contact details.

You represent and warrant that all information you provide to us is accurate, current, complete, and submitted with proper authority. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You may not transfer, sell, assign, license, or misuse your account or any access credentials connected to our website.

Section 2: Our Business Model and Products

Forged Echos LLC is an artist-centered e-commerce business that offers products using artwork, designs, graphics, and related creative content licensed from independent artists or otherwise owned or authorized for use by Forged Echos LLC.

Most products offered through our store are made to order. This means products are generally produced after an order is placed, rather than pulled from pre-existing Forged Echos inventory.

We use third-party vendors, including Printful, for print-on-demand production, fulfillment, packaging, shipping, and related operational support. Because of this made-to-order model, some order changes, cancellations, returns, refunds, and exchanges may be limited once production begins.

We make reasonable efforts to describe and display products accurately. However, colors, sizing, placement, scale, print appearance, fabric texture, and product details may vary based on device settings, screen display, production method, garment type, supplier availability, and fulfillment conditions.

We do not guarantee that the appearance, sizing, color, texture, or quality of any product will exactly match the images, mockups, previews, or descriptions displayed on our website.

All products, descriptions, prices, colors, sizes, specifications, and availability are subject to change at any time without notice. We reserve the right to modify, discontinue, limit, or remove any product, collection, artist page, product listing, or service at any time.

Section 3: Artist Designs and Licensed Works

Some products sold by Forged Echos LLC include artwork or designs licensed from independent artists. Purchasing a product does not transfer any ownership rights, copyright rights, trademark rights, reproduction rights, licensing rights, digital file rights, resale rights, or commercial use rights to you.

You may use purchased products for ordinary personal use. You may not copy, reproduce, scan, photograph for replication, trace, digitize, alter, distribute, sell, resell, sublicense, mint, tokenize, train artificial intelligence systems on, or otherwise exploit any artwork, product design, image, graphic, artist content, product mockup, or brand asset shown or sold through our website without prior written authorization from the proper rights holder.

Artist names, bios, images, shop pages, product listings, and related content are provided for customer information and brand presentation. Unless expressly stated otherwise, artist participation in Forged Echos does not make the artist an employee, partner, owner, agent, spokesperson, or legal representative of Forged Echos LLC.

Section 4: Orders

When you place an order, you are making an offer to purchase the selected product or products under these Terms and our posted policies.

Forged Echos LLC reserves the right to accept, decline, cancel, hold, or limit any order for any lawful reason, including suspected fraud, payment issues, pricing errors, product availability issues, fulfillment limitations, shipping restrictions, suspected misuse, policy violations, or operational concerns.

Your order is not accepted until payment is authorized and the order is confirmed through our store system. We may contact you using the email address, billing address, shipping address, or phone number provided at checkout if we need to address an order issue.

Please review your order carefully before submitting it. Because many products are made to order and may enter production quickly, we may be unable to change or cancel an order after it is submitted or accepted for fulfillment.

Your purchases are subject to our Refund Policy and Shipping Policy.

You represent and warrant that products purchased through our store are for personal, household, gift, or ordinary end-use purposes and not for unauthorized commercial resale, export, copying, reproduction, or exploitation.

Section 5: Pricing, Billing, Taxes, and Payment

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged for a product will generally be the price displayed at the time the order is placed, unless there is an error, inaccuracy, technical issue, or other pricing problem that requires correction. We reserve the right to correct pricing errors and cancel or adjust affected orders where permitted by law.

Unless otherwise stated, displayed product prices do not include taxes, shipping, handling, customs charges, import duties, carrier fees, or other charges that may apply.

You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information for all purchases made through our store.

You represent and warrant that you are authorized to use the payment method provided and that any charges incurred by you will be honored by your payment provider.

Payment processing may be handled by Shopify, Shopify Payments, PayPal, credit card processors, digital wallet providers, or other payment service providers made available through checkout. We do not control every aspect of third-party payment processing and are not responsible for delays, denials, holds, chargebacks, account reviews, or payment-provider actions outside our control.

Section 6: Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy and the shipping options available at checkout.

Because many products are fulfilled through third-party print-on-demand providers, production and delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by production issues, carrier delays, weather, customs processing, incorrect shipping information, address errors, failed delivery attempts, third-party fulfillment issues, platform outages, payment holds, or other events outside our reasonable control.

Once an order is transferred to the shipping carrier, delivery timing and tracking updates are controlled by the carrier. However, certain lost-package, damaged-package, or fulfillment-error claims may be reviewed under our Refund Policy and the applicable fulfillment partner’s claim process.

Customers are responsible for providing a complete and accurate shipping address at checkout. If an incorrect or incomplete address is submitted, we may be unable to correct it after the order enters fulfillment or ships. Additional shipping charges may apply if reshipment is available.

Section 7: Returns, Refunds, Reprints, and Exchanges

Returns, refunds, reprints, damaged-item claims, lost-package claims, incorrect-item claims, and exchange requests are governed by our Refund Policy.

Because most products are made to order through Printful or another third-party fulfillment provider, we generally do not accept returns, refunds, or exchanges for buyer’s remorse, wrong size selection, wrong color selection, wrong item selection, accidental orders not canceled before production, or change of mind.

If an item arrives damaged, defective, misprinted, mislabeled, or incorrect, you must contact us at support@forgedechos.com within the timeframe stated in our Refund Policy.

Do not send products back to Forged Echos LLC, Printful, or any other address unless we provide return instructions. Products sent back without prior approval may not be accepted or processed.

If a return is required, return routing and instructions may be handled through Printful or another fulfillment partner. Printful states that, by default, returns for orders fulfilled at its facilities go back to the corresponding Printful fulfillment location, and that any displayed Printful return address should be used only for product returns, not legal correspondence or business mail.

Section 8: Promotions, Discounts, and Gift Cards

We may offer promotions, discounts, coupon codes, gift cards, limited releases, limited-time offers, or special campaigns from time to time.

Promotions may be subject to separate terms, expiration dates, product limits, order limits, or eligibility restrictions. We may modify, suspend, or cancel promotions where permitted by law.

Gift cards, if offered, are subject to the terms displayed at purchase or redemption. Gift cards are not redeemable for cash except where required by law.

Sale items, discounted items, promotional items, and gift cards may be final sale unless otherwise stated or unless the item qualifies for a remedy under our Refund Policy.

Section 9: Charity and Community Support Statements

Forged Echos LLC may describe charitable goals, artist-supported causes, nonprofit relationships, community support efforts, or intended charitable contributions connected to the business or specific artist lines.

Unless expressly stated otherwise in writing, a purchase from Forged Echos LLC is a purchase of merchandise and is not a charitable donation by the customer. Customers should not treat purchases as tax-deductible charitable contributions unless Forged Echos LLC expressly provides written confirmation that a specific transaction qualifies under applicable law.

Any charitable contribution, community support amount, nonprofit relationship, artist-selected cause, or donation-related statement is subject to Forged Echos LLC approval, available profits, cash flow, accounting review, legal compliance, recipient eligibility, and applicable business policies.

We reserve the right to modify, pause, discontinue, or decline any charitable or community support program at any time unless a separate written agreement states otherwise.

Section 10: Intellectual Property

Our website, store design, brand identity, business name, logos, trademarks, trade dress, page layouts, text, images, graphics, product mockups, product descriptions, videos, audio, designs, collections, artist page structures, and related content are owned by Forged Echos LLC, licensed to Forged Echos LLC, or used with authorization.

The website and its content are protected by copyright, trademark, trade dress, and other intellectual property laws.

These Terms allow you to access and use our website for personal, non-commercial shopping and informational purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, scrape, store, transmit, sell, resell, exploit, or commercially use any portion of our website or content without prior written permission.

Nothing in these Terms grants you ownership of or rights in any Forged Echos LLC intellectual property, artist intellectual property, Shopify intellectual property, Printful intellectual property, or third-party intellectual property.

The names, logos, product names, service names, designs, slogans, and brand elements of Forged Echos LLC may not be used without prior written permission. The names, logos, product names, service names, designs, and slogans of Shopify, Printful, artists, vendors, and other third parties remain the property of their respective owners.

Section 11: Artist Applications and Submissions

If you submit an artist application, portfolio link, artwork sample, biography, social media handle, charity preference, contact information, or other artist-related material, that submission is for review and communication purposes only unless a separate written agreement states otherwise.

Submitting artwork, portfolio material, or artist information through our website does not guarantee acceptance, publication, product creation, licensing, payment, royalties, charity participation, or a business relationship with Forged Echos LLC.

Artist submissions are not treated as general “Feedback” under Section 16 to the extent they consist of artwork, portfolio materials, proposed licensed works, or artist onboarding information. Any commercial use of artist artwork by Forged Echos LLC must be governed by written approval, a signed artist agreement, or another written authorization accepted by Forged Echos LLC.

We may decline, remove, close, or not respond to artist applications or submissions in our discretion.

Artist application and onboarding questions should be sent to artist@forgedechos.com or application@forgedechos.com, as applicable.

Section 12: Third-Party Services, Tools, Vendors, and Links

Our website and services may include or rely on third-party platforms, tools, apps, links, vendors, and service providers. These may include Shopify, Printful, payment processors, shipping carriers, analytics providers, email systems, marketing tools, embedded features, or other third-party services.

We do not control all third-party tools, platforms, websites, policies, or systems. Your use of third-party tools or links may be subject to separate terms and privacy policies from those third parties.

We are not responsible for examining or evaluating the content, accuracy, policies, security, availability, or practices of third-party websites or services you choose to access. If you leave our website or interact with a third-party service, you do so at your own risk.

Complaints, claims, concerns, or questions about third-party services may need to be directed to the applicable third party, although customer order issues involving Forged Echos purchases should first be sent to support@forgedechos.com.

Section 13: Relationship with Shopify

Forged Echos LLC is powered by Shopify, which enables us to provide our online store and checkout services.

However, any sales and purchases made through our store are made directly with Forged Echos LLC, not Shopify.

By using our website and services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Forged Echos LLC, including any injury, damage, loss, return, refund, replacement, or other issue resulting from products or services purchased from Forged Echos LLC.

You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Forged Echos LLC.

Section 14: Privacy

Personal information collected through our website is governed by our Privacy Policy.

Because our website is hosted by Shopify, Shopify may collect and process personal information related to your access to and use of our website in order to provide, operate, secure, and improve the services available through Shopify.

Information submitted through our website may be transmitted to or processed by Shopify and other third-party service providers, which may be located in jurisdictions other than where you reside.

Please review our Privacy Policy for more information about how Forged Echos LLC, Shopify, and our service providers may collect, use, disclose, retain, or protect personal information.

Section 15: Errors, Inaccuracies, and Omissions

Occasionally, information on our website may contain typographical errors, inaccuracies, omissions, outdated information, or incorrect details relating to product descriptions, artwork descriptions, prices, promotions, offers, shipping charges, transit times, availability, artist information, or other content.

We reserve the right to correct errors, inaccuracies, or omissions and to change, update, cancel, or modify orders if information is inaccurate at any time, including after an order has been submitted, where permitted by law.

We are not obligated to update, amend, or clarify information except as required by law.

Section 16: Feedback, Reviews, and Non-Artist Suggestions

If you submit reviews, ratings, comments, ideas, suggestions, feedback, proposals, or similar non-artist materials to us, you grant Forged Echos LLC a worldwide, royalty-free, sublicensable, transferable, perpetual license to use, reproduce, modify, publish, translate, distribute, display, and otherwise use that feedback in any medium for business, marketing, operational, product improvement, or promotional purposes.

This Feedback section does not apply to artwork, portfolio samples, proposed licensed works, artist application materials, or artist onboarding materials submitted for possible licensing or collaboration, which are addressed in Section 11.

You represent and warrant that any feedback, review, comment, or suggestion you submit does not violate the rights of any third party and does not contain unlawful, defamatory, abusive, obscene, misleading, fraudulent, infringing, malicious, or harmful content.

We may monitor, edit, remove, reject, or decline to publish feedback, reviews, comments, or other submitted content in our discretion.

You may not use a false email address, impersonate another person, or mislead us or others about the origin of submitted content.

Section 17: Prohibited Uses

You may use our website and services only for lawful purposes.

You may not access or use the website or services, directly or indirectly:

For any unlawful, fraudulent, harmful, malicious, abusive, or deceptive purpose.

To violate any federal, state, local, international, or other applicable law or regulation.

To infringe or violate our intellectual property rights or the rights of artists, vendors, Shopify, Printful, customers, or other third parties.

To copy, scrape, harvest, download, reproduce, extract, train on, or commercially exploit website content, product listings, artist content, artwork, images, product mockups, customer information, or other protected material.

To submit false, misleading, incomplete, or unauthorized information.

To harass, abuse, insult, harm, defame, slander, disparage, intimidate, threaten, or discriminate against any person.

To upload or transmit viruses, malware, worms, logic bombs, malicious code, or other harmful material.

To interfere with, disrupt, bypass, reverse engineer, attack, or circumvent website security, access controls, payment systems, checkout systems, robots.txt files, technical restrictions, or authentication features.

To use bots, scrapers, crawlers, automated tools, AI agents, or other automated systems to access, scrape, test, purchase, submit, or interact with the website without our prior written permission.

To send spam, phishing messages, fraudulent communications, chain letters, junk mail, or unauthorized promotional material.

To impersonate Forged Echos LLC, an artist, another customer, Shopify, Printful, or any other person or entity.

To place orders for unauthorized resale, export, counterfeit production, product copying, intellectual property misuse, or fraudulent activity.

We reserve the right to suspend, restrict, disable, or terminate access to our website or services if we determine that you have violated these Terms.

Section 18: Automated Agents and AI Tools

This section applies if you use, enable, deploy, or cause any automated agent, bot, crawler, scraper, AI tool, browser automation, autonomous software, semi-autonomous software, or similar technology to access or interact with our website.

No automated tool may access, use, scrape, test, submit forms, place orders, harvest information, download content, or interact with our website in a way that violates these Terms, bypasses technical controls, creates operational burden, misrepresents its identity, or interferes with normal website activity.

Any permitted automated access must clearly identify itself, comply with applicable technical restrictions, comply with our instructions, and stop accessing the website if requested.

We may block, throttle, restrict, or prohibit automated access at any time.

Section 19: Termination

We may terminate, suspend, restrict, or disable your access to the website or services, in whole or in part, at any time and without notice if we determine that you have violated these Terms, created risk for Forged Echos LLC, misused the website, submitted fraudulent information, interfered with operations, infringed intellectual property rights, or engaged in unlawful or harmful activity.

You remain responsible for all amounts due up to and including the date of termination.

Sections that by their nature should survive termination will continue to apply, including sections related to intellectual property, artist content, feedback, privacy, prohibited uses, disclaimers, limitation of liability, indemnification, governing law, and dispute-related provisions.

Section 20: Disclaimer of Warranties

The website, services, content, product listings, artist pages, product information, and all products offered through the website are provided “as is” and “as available,” except as expressly stated by Forged Echos LLC in writing.

We do not guarantee that the website or services will be uninterrupted, timely, secure, error-free, accurate, complete, or available at all times.

We do not warrant that any product will meet your expectations or exactly match a product image, mockup, color display, size expectation, or description, except to the extent required by applicable law or expressly stated in our Refund Policy.

To the fullest extent permitted by law, we disclaim all warranties and conditions, express or implied, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Some jurisdictions do not allow certain warranty disclaimers, so some of these limitations may not apply to you.

Section 21: Limitation of Liability

To the fullest extent permitted by law, Forged Echos LLC, its members, managers, officers, employees, contractors, service providers, vendors, licensors, artists, affiliates, Shopify, Printful, and related third parties will not be liable for any indirect, incidental, punitive, special, consequential, exemplary, or similar damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, business interruption, reputational harm, or similar damages.

This limitation applies whether the claim is based in contract, tort, negligence, strict liability, warranty, statute, or any other legal theory.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to your use of the website, services, or products purchased through the website will not exceed the amount you paid to Forged Echos LLC for the specific product or order giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

Section 22: Indemnification

You agree to indemnify, defend, and hold harmless Forged Echos LLC, Shopify, Printful, our affiliates, members, managers, officers, employees, contractors, service providers, vendors, licensors, and artists from and against any losses, damages, liabilities, claims, demands, judgments, settlements, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

Your breach of these Terms or any policy incorporated by reference.

Your violation of any law or regulation.

Your violation of any third-party right, including intellectual property, privacy, publicity, or contractual rights.

Your misuse of the website, products, artist content, brand assets, services, or account features.

Your fraudulent, harmful, unauthorized, or unlawful conduct.

We may control the defense and settlement of any indemnified claim, including the choice of counsel, where permitted by law. You agree to cooperate in the defense of indemnified claims.

Section 23: Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be deemed severed from these Terms.

The remaining provisions will continue in full force and effect.

Section 24: Waiver and Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with our posted policies and any terms incorporated by reference, constitute the entire agreement between you and Forged Echos LLC regarding your use of the website, services, and purchases from our store.

These Terms supersede prior or contemporaneous communications, proposals, or agreements between you and Forged Echos LLC regarding the website, services, or store purchases, except for separate written agreements signed by Forged Echos LLC.

If you are an artist, vendor, contractor, or other business partner with a separate signed agreement with Forged Echos LLC, that signed agreement controls only with respect to the subject matter it expressly governs.

Section 25: Assignment

You may not transfer, assign, delegate, or sublicense these Terms or any rights or obligations under them without prior written consent from Forged Echos LLC.

We may transfer, assign, or delegate these Terms and our rights and obligations in connection with business operations, restructuring, sale, merger, acquisition, transfer of assets, platform change, or other lawful business activity.

Section 26: Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms, the website, services, or purchases from Forged Echos LLC will be governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

To the extent a court proceeding is permitted or required, you and Forged Echos LLC consent to personal jurisdiction and venue in the state or federal courts located in Michigan, in or serving the county where Forged Echos LLC maintains its principal place of business, unless applicable law requires otherwise.
